After his open letter to the director of Midnight Rider failed last week to convince the film’s producers to halt production, Gregg Allman is taking further action to make sure the biopic never sees the light of day.

Reports say Allman is suing, claiming the production company lost its right to film when it failed to begin principal photography by February 28th.

Although Allman was originally in support of the film, a tragic accident on set which killed a 27-year-old camera assistant caused him to change his tune.

“The reality of Sarah Jones’ tragic death, the loss suffered by the Jones family and injuries to the others involved has led me to realize that for you to continue production would be wrong,” Allman’s letter to director Randall Miller reads.

The accident happened February 20th when crew were filming on a set of train tracks in Wayne County, GA without permission from the railroad. The case is still being investigated by local police.

Actor William Hurt, who was set to play Allman, has since backed out of the film. He had expressed his safety concerns about the location to a friend via email just days before the accident took place.
