Iconic Photo of the Boss and the Big Man Subject of Lawsuit

An iconic photograph of Bruce Springsteen and Clarence Clemons is at the center of a federal copyright infringement lawsuit against a number of online retailers, KRQE reports.

The photograph, taken by rock and roll photographer James Shive during a 1978 show at the Spectrum in Philadelphia, features Clemons in the foreground playing saxophone and Springsteen in the background with one arm up in the air. It was used, with proper rights, by Rolling Stone magazine following the Big Man’s death in 2011.

However, according to the lawsuit, a number of online retailers and their vendors have been selling the photo in various formats online. The retailers include Amazon, Wal-Mart and eBay, among others.

Shive is seeking damages including what the retailers made by selling his image (an amount in excess of $50,000). He would also like to stop them from being able to sell the photograph.
